sales vote. right now, a clear majority of the united states senate supports the toomey amendment. 62 senators on record for it. 40 on record against it. that should be great news for people who want background checks, right? after newtown, it's got clear majority support to expand background checks. except the republicans are filibustering it so majority won't matter. the 40 senators who are voting no are not committed to voting against the background check. they are voting against there allowing to be a vote on the background check on the amendment. they are voting to filibuster. a majority is voting in favor, so they are going to try to block the up or down vote. jeff flake waited until the coverage of the bombings last night to announce, quietly, silently, in fact, on his facebook page that he will vote against background checks. eight in ten of his constituents in arizona support background checks. he said last night or rather wrote to facebook last night that he's going to vote no. he's voting to filibuster, quietly. that was last night around 9:00 p.m. hey, arizona senator, jef

and the united states senate for a reason. we decided to run for this high office because of issues we deeply care about whether it be more affordable health care or better housing or lower taxes and in a job like this you are driven to find the issues that move you. and then sometimes there are issues that find you. when i was elected to the united states senate last november i never imagined that my main speech would be about guns or about gun violence. just like i could have never imagined that i would be standing here in the wake of 20 little kids having died at sandy hook or six adults who protected them. but sometimes issues find you and so here i am. i'm so pleased to have the majority leader and the majority whip and so many of my colleagues on the floor with me here today. i want to start though with the unpleasant part. i think it's important for all of my colleagues to understand why we are having this debate this weekend next week about gun violence and why in the first time in decades we were able to break the logjam. it's easy to avert your eyes and what happened in newtown. it'

minutes ago, a minority in the united states senate decided it was not worth it. gun blocked commonsense reform even while these families looked on from the senate gallery. by now, it is well-known that 90% of the american people support universal background checks that make it harder harder for a dangerous person to buy a gun. were talking about convicted felons, people convicted of domestic violence, people with severe mental illness. 90% of american support that idea. most americans think that is already the law. a few minutes ago, 90% of democrats in the senate voted for that idea. but it is not going to happen is 90% of republicans in the voted against that idea. a majority of senators voted yes to protecting more of our citizens with smarter background checks. but by this continuing distortion of senate rules, a minority was able to block it from moving forward. i will speak lately and honestly about what happened. the american people are trying to figure out how it didn't happen. we had a democrat and a republican, both gun owners, both fierce defenders of the second amendment wit

"happening now.". rick: fox news alert. news out of d.c. the united states senate rejected effort to block debate on new gun control legislation. the senate voting 68-31 to allow debate to go on. 16 republican senators voted in favor of the debate. two democrats voted against the debate. this does not mean all of sudden there are new gun laws on the books. it simply means the senate will debate new gun legislation for the first time in 20 years. the deal worked out, bipartisan deal on expanded background checks will most likely be a part of what they will be debating. there will be other amendments as well. still a long way to go before any new gun legislation gets to the president's desk. but the first hurdle at least has been overcome. jenna: more on that as we get it. meantime the dairy industry is looking for a sweet deal, pun intended hoping to add sweetener to make. fda considering this proposal but the plan is coming under fire from some farmers and as well as some consumer groups as well. doug kennedy is live at our new york city newsroom. not to confuse my dougs in my life. there

the united states, will be briefing members of congress tomorrow morning. first it will be the house intelligence committee and then we anticipate the senate intelligence committee in the afternoon. as you know late today the chair of that committee, democrat dianne feinstein has come out and called it an act of terrorism in boston. this is fluent at this point. i was told by a source familiar with the investigation that they believe between two and five unexploded devices have been discovered in connection to what happened to boston earlier today and that's pretty consistent also with what the "wall street journal" is reporting earlier this evening. we 130 to congressman mike mccall, who has been briefed on the investigation, and he said he was getting initial reporting that shrapnel had been identified in the devices, and in this case specifically ball bearings. this is more evidence to show that the devices were designed to create a maximum number of casualties and also injuries. the fbi is on the ground in boston. they are taking that marathon route, which has now become a crime
